A non fire rated device is one that has to positively latch every time it closes, you can usually tell, because a non fire rated device has the hex key dogging.  This is the part that may be causing your bottom latch to drag on the floor. The Top Latch does all the work on the Von Duprin 8827. When the Top Latch is retracted, it holds the rods in the retracted position.
